Improve public body decision making rather than cutting the ability of people to go to judical review, says Law Society.  Article HERE on the Law Society’s submission for the consultation on whether to make it harder for people to go to judicial review.

..…Undermining recourse to judicial review will in time erode acceptance of public authority in this country, the Law Society has warned. …..

….. It argued: “The majority of claims are genuine claims reflecting strongly arguable cases and they should not be prohibited. Rather, the approach should be to encourage public authorities to take greater care to ensure that their decision making is legally sound.

“In default of that remedy to the problem, sufficient resources must be made available to enable the Administrative Court to deal more promptly with the number of judicial reviews being brought. These proposals will serve to make it more difficult and more expensive for members of the public and NGOs to challenge the actions and decisions of public bodies.” …..
